Contracting Goods and Services: The United Nations Convention on Contracts For the International Sale of Goods (CISG) and its Role in the Mining Industry

Daniel P. Altikes, Michael J. Bourassa, Martin Ferreira Pinho, Mining Agreements: Contracting for Goods and Services

As the countries of the world become increasingly intertwined, international law and its impact on domestic legal systems is of increasing importance and relevance. This paper looks at the role of the CISG and the legal framework in which the international sale of goods between private businesses takes place. In Part I of this paper, we provide an overview of the CISG. In Part II, we offer a high-level comparison between the common law and civil law approaches to sale of goods contracts, and the relative position of the CISG. The paper concludes with Part III, where we contemplate the application of the CISG in the mining context.
