Ethics and Efficiency in Mineral Title Examination

Presented by DAVID G. EBNER, Lohf Shaiman Jacobs Hyman & Feiger PC, Denver,
at the Special Institute on Advanced Mineral Title Examination on January 24, 2014

Everyone wants opinions quickly, but what if quick preparation risks time-consuming problems with curative or unclaimed property down the road? Some problems can be avoided by communicating with other attorneys, landmen, clients, and non-clients in the course of the examination, but what of attorney-client confidentiality? And if we tailor opinions to specific clients to save money, what will happen when those opinions are later relied upon by another examiner? What can we ethically do if tiny tracts in a unit present outsized problems? So many questions, so little time  just like examining title.
